Legal text retrieval serves as a key component in a wide range of legal text processing tasks such as legal question answering, legal case entailment, and statute law retrieval. The performance of legal text retrieval depends, to a large extent, on the representation of text, both query and legal documents. Based on good representations, a legal text retrieval model can effectively match the query to its relevant documents. Because legal documents often contain long articles and only some parts are relevant (...) to queries, it is quite a challenge for existing models to represent such documents. In this paper, we study the use of attentive neural network-based text representation for statute law document retrieval. We propose a general approach using deep neural networks with attention mechanisms. Based on it, we develop two hierarchical architectures with sparse attention to represent long sentences and articles, and we name them Attentive CNN and Paraformer. The methods are evaluated on datasets of different sizes and characteristics in English, Japanese, and Vietnamese. Experimental results show that: (i) Attentive neural methods substantially outperform non-neural methods in terms of retrieval performance across datasets and languages; (ii) Pretrained transformer-based models achieve better accuracy on small datasets at the cost of high computational complexity while lighter weight Attentive CNN achieves better accuracy on large datasets; and (iii) Our proposed Paraformer outperforms state-of-the-art methods on COLIEE dataset, achieving the highest recall and F2 scores in the top-N retrieval task. Assess to quality diets is a basic human right. Geographical challenges and cultural traditions have contributed to the widespread malnutrition present among ethnic minorities of mountainous areas in Northwest Vietnam. Home gardens can play a role in increased diet diversity and micronutrient intakes. However, low production yields and plant diversity in ethnic home gardens have limited their contributions to household food security and nutrition. The pilot study tested a home garden intervention in weekly vegetable harvests and increasing household production and (...) consumption of diverse vegetables year-round. Food ethics issues encountered included limited access to quality food by resource-poor groups, conflicts arising from low preference and value given to some nutritious foods, limited access to information and technology for food production and consumption, each of which were addressed in the study design. The intervention includes: (1) nutrition-focused home garden training and (2) locally-adapted home garden packages consisting of garden planning, technical assistance, and high-yielding seed varieties. Twenty households from two ethnic villages in Son La province participated in the study and were randomly assigned into two groups (intervention and non-intervention). The total vegetable supply from weekly harvests of home garden produce was significantly higher in the intervention households (226 kg) compared to the non-intervention households (39 kg). The intervention group yielded 5.8 and 1.7 times more vegetables by weight and weight per area than those without the intervention. The vegetables were mainly consumed at home for both groups, but the intervention households gave more vegetables as gifts to neighbors. The intervention group cultivated a higher diversity of vegetables with a total of 42 different vegetables compared to 24 in the non-intervention group, which is reflected in an overall higher nutritional yield of vitamin A, iron, other micronutrients and phytochemicals. The home garden training significantly improved the amount, diversity and continuity of household food and nutrient supply. The home garden model is effective and could be scaled up to improve household vegetable supply and consumption, particularly in Northwest Vietnam. (shrink)

As the first empirical study of the nonlinear effects of digital business on global value chains (GVC), we provide insight into the nonlinear effects of digital business on the global value chain (GVC) values. We employ four indicators, including the value of online selling, sales through E-commerce, and customer relationship management (CRM) usage, to capture the prevalence of digital business in the economy. By testing a sample of 25 European countries that have been analyzed using various econometric techniques over the (...) period 2012–2019, our estimation results confirm that GVC values are a U-shaped function of digitalization. That is, an increase in digitalization pervasiveness initially induces more significant risks and uncertainties, hindering European countries from getting involved in or scale-up within the GVC. However, a rise in digitalization pervasiveness goes beyond a specific threshold, which facilitates GVC activities as more opportunities are created. Furthermore, our findings suggest that digital business contributes significantly to reducing the adverse influences of global uncertainty on the GVC values, while the marginal effects of digital business on GVC values become more pronounced in countries with the most advanced institutional structure. This article responds to scholarly calls to engage with diaspora in the context of transnational educational mobilities in global higher education. It maintains that transnational academic mobilities produce a particular kind of academic diaspora, that is often valued by both home and host countries but in ways that vary and serve different interests and aspirations. While the contrasting perspectives on brain circulation and brain drain persist, what this article argues is that systemic inequalities are (re)produced through the processes of transnational (...) academic mobilities, which privilege the mobility of some and not others, and at the same time under-value the home-grown academics and overseas-trained academics that return home. The current diaspora politics is located within this complex, hierarchical, and dynamic cultural, political and economic space. In particular, it pinpoints how the promoted desirability of diasporic brains and talents in policy and practice has co3ntinued to reproduce and consolidate academic inequalities. The article then argues for place-based/at home transnationality, seeing it as productive counter position to help reduce inequalities. The article employs self-study research and is informed by a bricolage of data on Vietnam and its Vietnamese transnational academic diasporas gathered at different points in time and in different contexts. The so-called Baldwin Effect generally says how learning, as a form of ontogenetic adaptation, can influence the process of phylogenetic adaptation, or evolution. This idea has also been taken into computation in which evolution and learning are used as computational metaphors, including evolving neural networks. This paper presents a technique called evolving self-taught neural networks – neural networks that can teach themselves without external supervision or reward. The self-taught neural network is intrinsically motivated. Moreover, the self-taught neural network is the (...) product of the interplay between evolution and learning. We simulate a multi-agent system in which neural networks are used to control autonomous agents. These agents have to forage for resources and compete for their own survival. Experimental results show that the interaction between evolution and the ability to teach oneself in self-taught neural networks outperform evolution and self-teaching alone. More specifically, the emergence of an intelligent foraging strategy is also demonstrated through that interaction. Indications for future work on evolving neural networks are also presented. Combining elements from Heidegger’s philosophy of “being-in-the-world” and the tradition of Jewish theology, Levinas has evolved a new type of ethics based on a concept of “the Other” in two different but complementary aspects. He describes his encounters with those philosophers and literary authors (most of them his contemporaries) whose writings have most significantly contributed to the construction of his own philosophy of “Otherness”: Agnon, Buber, Celan, Delhomme, Derrida, Jabès, Kierkegaard, Lacroix, Laporte, Picard, Proust, Van Breda, Wahl, and, most notably, (...) Blanchot. At the same time, Levinas’s own texts are inscriptions and documents of those encounters with “Others” around which his philosophy is turning. Thus the texts simultaneously convey an immediate experience of how his intellectual position emerged and how it is put into practice. A third potential function of the book is that it unfolds the network of references and persons in philosophical debates since Kierkegaard. (shrink)

Case law retrieval is the task of locating truly relevant legal cases given an input query case. Unlike information retrieval for general texts, this task is more complex with two phases (legal case retrieval and legal case entailment) and much harder due to a number of reasons. First, both the query and candidate cases are long documents consisting of several paragraphs. This makes it difficult to model with representation learning that usually has restriction on input length. Second, the concept of (...) relevancy in this domain is defined based on the legal relation that goes beyond the lexical or topical relevance. This is a real challenge because normal text matching will not work. Third, building a large and accurate legal case dataset requires a lot of effort and expertise. This is obviously an obstacle to creating enough data for training deep retrieval models. In this paper, we propose a novel approach called supporting model that can deal with both phases. The underlying idea is the case–case supporting relation and the paragraph–paragraph as well as the decision-paragraph matching strategy. In addition, we propose a method to automatically create a large weak-labeling dataset to overcome the lack of data. The experiments showed that our solution has achieved the state-of-the-art results for both case retrieval and case entailment phases. (shrink)

Genre has been a critical issue in discourse analysis as well as in other disciplines. Based on a literature review of the concept of genre and taking judgments as one type of genre in legal settings, the present study provides a corpus-based insight into the nature of genre. The literature review per se reveals that genre has one typical feature of a sign, that is, being subject to multiple and alternative interpretations; in other words, genre as a sign may have (...) various interpretants. The present study unravels the actual generic structures, distinguishes different types of generic structures within the given genre, and then defines the dominant generic structure of judgments in Hong Kong, Taiwan, and Mainland China. This study also examines and contrasts the generic structure potential of judgments in each jurisdiction. In addition, the variation of Mainland China's judgments over time is briefly discussed. Comparing the generic structures of judgments among the three jurisdictions, as well as the structures of judgments in Mainland China over time, the paper argues that genre also has the essential features of a sign, that is, the characteristics of temporality and spatiality. I begin by giving reasons to accept the block-universe view, the strongly supported by physics view that we live in a four-dimensional world. According to it, the past and the future are as real as the present. As a result, it seems that the future is determined in the sense that what will be the case will necessarily be the case. In the dissertation, I examine whether we have to accept this consequence. I show that we do not have to (...) bite the bullet: the future might be both real and contingent. I first start to consider modal realism (possible futures are real) as a possible solution. However, I propose then another account, actualist (positing the reality of only one possible world: the space-time we live in). This solution relies on a conventionalist theory about metaphysical modality (Sidelle, 1989). It states that modal modality is purely conventional. In combination with a realist interpretation of natural modality (causal and/or nomological), this framework allows me to propose that the future is conventionally closed and naturally contingent. In this view, the necessity of the future holds in virtue of linguistic conventions and then is conventionally necessary. But this is a distinct phenomenon from the natural contingency of the future: the future is naturally contingent because there are mind-independent probabilistic relations holding between the present and the future. This solution has strong consequences: most importantly, an anti-realist view about ordinary objects and physical particles. I end up by presenting and arguing in favour of the general image of the world that comes out from these views. (shrink)

In the trust-health relationship, how trusting other people in society may promote good health is a topic often examined. However, the other direction of influence – how health may affect trust – has not been well explored. In order to investigate this possible effect, we employed Bayesian Mindsponge Framework (BMF) analytics to go deeper into the information processing mechanisms underlying the expressions of trust. Conducting Bayesian analysis on a dataset of 1237 residents from Cali, Colombia, we found that general health (...) status is positively associated with generalized trust, but recent experiences of illnesses/injuries have a negative moderating effect. Personalized trust is largely unchanged across different general health conditions, but the trust level becomes higher with recent experiences of illnesses/injuries. Psychophysiological mechanisms of increasing information filtering intensity toward unfamiliar sources during a vulnerable state of health is a plausible explanation of found patterns in generalized trust. Because established personal relationships are reinforced information channels, personalized trust is not affected as much. Rather, the results suggest that people may rely even more on loved ones when they are in bad health conditions. This exploratory study shows that the trust-health relationship can be examined from a different angle that may provide new insights. (shrink)

How should state schools respond to the plurality of values in a multicultural society? The liberal response has been that it is unacceptable to promote only the traditional, mainstream values of dominant groups and impose them on others. During the 1980s this response gradually evolved into an ideology of extreme subjectivism, commonly referred to as cultural relativism. This ideology is rejected and it is argued that the school must make crucial judgements about which values should be promoted, tolerated or condemned.

Most people know Ursula K. Le Guin for her extraordinary science fiction and fantasy writing. Fewer know just how pervasive Taoist themes are to so much of her work. And in Lao Tzu: Tao Te Ching, we are treated to Le Guin's unique take on Taoist philosophy's founding classic. ABSTRACT In this paper we explore how a public national media outlet, the British BBC, represents an international legal case which has a highly political nature. The case is US versus Huawei/meng Wanzhou, which took place between 2018 and 2021. Accusations were that the Chinese technology company committed fraud, leading the global HSBC bank to breach US sanctions against Iran. The charges were made by the US using what is called an ‘extraterritorial law’, which, while rejected as law by governments (...) around the world, is policed by US economic powers and control over international finance. Using Critical Discourse Analysis we show that, while the BBC presents much detail of legal process, the actual nature of the law the US uses to bring criminal charges against international companies and banks, is neither considered nor questioned. Our interest is how such a law, which has a huge influence over global trade and politics, is presented to the public in this particular case. We contribute to the position that the nature of laws, how they are used and known, must always be understood within the prevailing discourses of the moment. (shrink)

Many Chinese pianists, Lang Lang and Yun-di Li for example, received international recognition in recent years. When study the history of piano study and composing in China, it is not surprising that the history of Chinese piano music has gone through specific periods which strongly influenced compositional activities. This article is aimed to display cultural and political aspects that are behind historical period and analyses representative work in compositional style and characteristics.

One of the most influential philosophers of our day has selected 16 previously uncollected pieces that are unified by Levinas's project of revising the phenomenological description of the world in light of our experience of other persons.

A number of philosophers have argued in favour of extended simples on the grounds that they are needed by fundamental physics. The arguments typically appeal to theories of quantum gravity. To date, the argument in favour of extended simples has ignored the fact that the very existence of spacetime is put under pressure by quantum gravity. We thus consider the case for extended simples in the context of different views on the existence of spacetime. We show that the case for (...) extended simples based on physics is far more complex than has been previously thought. Space and time are the most fundamental features of our experience of the world, and yet they are also the most perplexing. Does time really flow, or is that simply an illusion? Did time have a beginning? What does it mean to say that time has a direction? Does space have boundaries, or is it infinite? Is change really possible? Could space and time exist in the absence of any objects or events? What, in the end, are space and time? (...) Do they really exist, or are they simply the constructions of our minds? Robin Le Poidevin provides a clear, witty, and stimulating introduction to these deep questions and many other mind-boggling puzzles and paradoxes. He gives a vivid sense of the difficulties raised by our ordinary ideas about space and time, but he also gives us the basis to think about these problems independently, avoiding large amounts of jargon and technicality. His book is an invitation to think philosophically rather than a sustained argument for particular conclusions, but Le Poidevin does advance and defend a number of controversial views. He argues, for example, that time does not actually flow, that it is possible for space and time to be both finite and yet be without boundaries, and that causation is the key to an understanding of one of the deepest mysteries of time: its direction. According to presentism, only the present exists. The view is in a bad dialectical situation since it has to face several objections based on physics and a priori arguments. The view remains nonetheless popular because it is, allegedly, more intuitive than alternative views, namely eternalism (past, present and future entities exist) and no-futurism (only past and present entities exist). In the essay, I shall not discuss whether intuitivity is an accurate criterion for ontological enquiry. I will rather argue that any (...) philosophically acceptable version of presentism entails highly counterintuitive consequences. Indeed, the presentist has to commit herself to substantial claims in order to provide an answer to two problems : the grounding problem and the cross-temporal relations problem. Therefore, if the main motivation for presentism is the willingness to stick with common sense intuitions, presentists should consider endorsing another view about existence in time. (shrink)

Over the last decade, businesses, policymakers, and researchers alike have advocated the need for value creation through inter-organizational collaboration. Researchers have widely argued that organizations that are engaged in collaborative processes create value. Because researchers have tended to focus on the identification of organizational motivations and on key success factors for collaboration, however, both the nature and processes of value creation in inter-organizational collaboration have yet to be examined. A recent theory by Austin and Seitanidi :726–758, 2012a; Nonprofit Volunt Sect (...) Q 41:929–968, 2012b) has proposed an analytical framework for analyzing value creation in inter-organizational collaboration, based on four types of value. The purpose of this current study is to empirically test this framework, and to provide key pointers for analyzing the nature of value, particularly in relation to learning. Our detailed empirical research is based on a 6-year retrospective case study of an inter-organizational partnership within an international development project for local economic development in Guatemala. The study’s contributions are twofold. First, it provides evidence of the critical path of the creation of diverse types of values in a collaborative process; second, it links the different types of value creation with the types of learning that occur in an inter-organizational process. Law as one sign system can be recorded and interpreted by another sign system—media. If each transaction in court is taken as a sign, it can be interpreted or transferred by different signs of media for the same purpose, though with different effects. This study focuses on the transformative effects of the semiotic revolution in media on law. The present research revealed that the evolution of media has driven the administration of justice to pay more attention to the process of (...) court proceedings. This research also discusses the semiotic conflict and compatibility between the sign subsystems within media upon interpreting the administration of justice. In addition, disequilibrium between different sign systems highlights the consequent need for intersemiotic translation, consciousness and evaluation as part of decision making on court domains. E. J. Lowe sets out in a recent paper1 to refute McTaggart's proof of the unreality of time, by exposing an ‘indexical fallacy’ in his disproof of the existence of tensed (i. e., A-series) facts.2 Lowe then develops an original account of what makes time the dimension of change, based on his own account of tensed facts. But in our opinion he fails on both counts: (1) he fails to refute McTaggart's perfectly sound disproof of tensed facts, which shows that (...) time can be real only if (Lowe and McTaggart not withstanding) it needs no tensed facts, and (2) he fails to explain the temporal character of change, since his account of it has an exact spatial analogue. Photographs, paintings, rigid sculptures: all these provide examples of static images. It is true that they change—photographs fade, paintings darken and sculptures crumble—but what change they undergo is irrelevant to their representational content. A static image is one that represents by virtue of properties which remain largely unchanged throughout its existence. Because of this defining feature, according to a long tradition in aesthetics, a static image can only represent an instantaneous moment, or to be more exact the state of affairs (...) obtaining at that moment'. It cannot represent movement and the passage of time. This traditional view mirrors a much older one in metaphysics: that change is to be conceived of as a series of instantaneous states and hence that an interval of time is composed of extensionless moments. The metaphysical view has been involved in more controversy than its aesthetic counterpart. Aristotle identified it as one of the premises of Zeno's arrow paradox and Augustine employed it in his proof of the unreality of time. (shrink)

Are we the people we were? If we are continuants, then the answer to this question is an affirmative one. But it is a moot point whether anything is a continuant. The debate over this issue—of whether there are such things as continuants—is often conducted in the context of theories concerning the apparent passage of time. Thus it has been argued that the tenseless theory of time, according to which time does not really pass, forces us to tear down part (...) of the basis for the intuitive distinction between ordinary, reidentifiable objects on the one hand, and processes on the other, and to regard such objects as mountains as persisting through time in exactly the way that thunderstorms do: by having distinct temporal parts at different times. I confess that I am a tenseless theorist of time, and take that theory to entail such a conclusion about the persistence of objects. But it is not just a certain stance over time’s passage that motivates sympathy towards temporal parts and suspicion of continuants. Thinking of objects as having temporal parts sits more comfortably than does the rival view with two natural assumptions concerning continuity: that beginning and ceasing to exist, at least for most objects, involves underlying changes which are continuous in nature; and that objects exhibit continuity through time, in the sense of not having gaps in their existence. In public debate over agricultural biotechnology, at issue hasbeen its self-proclaimed aim of further industrializingagriculture. Using languages of ’risk‘, critics and proponentshave engaged in an implicit ethics debate on the direction oftechnoscientific development. Critics have challenged thebiotechnological R&D agenda for attributing socio-agronomicproblems to genetic deficiencies, while perpetuating the hazardsof intensive monoculture. They diagnosed ominous links betweentechnological dependency and tangible harm from biotechnologyproducts.In response to scientific and public concerns, theEuropean Community enacted precautionary legislation for theintentional release of genetically modified organisms (GMOs). Inits implementation, choices for managing and investigatingbiotechnological risk involve an implicit environmental ethics.Yet the official policy language downplays the inherent valuejudgments, by portraying risk regulation as a matter of’objective‘ science.In parallel with safety regulation, thestate has devised an official bioethics that judges where to’draw the line‘ in applying biotechnological knowledge, as ifthe science itself were value-free. Bioethics may also judge howto ’balance‘ risks and benefits, as if their definition were notan issue. This form of ethics serves to compensate for theunacknowledged value-choices and institutional commitmentsalready embedded in R&D priorities.Thus the state separates’risk‘ and ’ethics‘, while assigning both realms to specialists.The risk/ethics boundary encourages public deference to theexpert assessments of both safety regulators and professionalethicists. Biotechnology embodies a contentious model of controlover nature and society, yet this issue becomes displaced andfragmented into various administrative controls. The revival of recognition theory has brought new energy to critical theory. In general terms, recognition theory aims to critically evaluate social structures against a standard of social freedom identified with norms of interaction which are freely recognized by all parties. Until now, attention has primarily focused on the categories and forms of recognition theory. However, the influence of contemporary French theory upon the development of theories of recognition has not yet received the consideration it merits. The book takes up (...) this task. With chapters by internationally recognized authors, the collection outlines the current state of recognition theory, studies the impact of French theory, and uses French thought to identity aspects of the recognitive process which are often overlooked. Exploring French accounts of agonistic identity construction, vulnerability, power, ethical obligation, and reflexive theory construction, this book supports the intentions of critical theory with heightened attentiveness to oppression in all of its forms. Nonhuman animal farming, by its fundamental nature, involves a greater or lesser degree of ill treatment and oppression. Definitions of abuse or cruelty in relation to nonhumans, however, are inconsistent and ambiguous. People support nonhuman farming by purchasing its products, but the majority of people do not themselves mistreat nonhumans. How can this incongruity be explained? Any account is likely to be complex, but work in experimental psychology has identi- fied a number of conditions that can contribute toward individuals becoming (...) morally disen- gaged from abusive acts. This paper shows that a number of these conditions are embedded in the nonhuman animal farming industry, thus providing some insight into why consumers may be disconnected from the mass abuse carried out by an industry they support. Recognizing this process can help advocates for nonhumans take steps to counter this disengagement and so allow consumers to examine their ethical choices more clearly. (shrink)

The study of the autonomic nervous system (ANS) function has shown to provide useful indicators for risk stratification and early detection on a variety of cardiovascular pathologies. However, data gathered during different tests of the ANS are difficult to analyse, mainly due to the complex mechanisms involved in the autonomic regulation of the cardiovascular system (CVS). Although model-based analysis of ANS data has been already proposed as a way to cope with this complexity, only a few models coupling the main (...) elements involved have been presented in the literature. In this paper, a new model of the CVS, representing the ventricles, the circulatory system and the regulation of the CVS activity by the ANS, is presented. The models of the vascular system and the ventricular activity have been developed using the Bond Graph formalism, as it proposes a unified representation for all energetic domains, facilitating the integration of mechanic and hydraulic phenomena. In order to take into account the electro-mechanical behaviour of both ventricles, an electrophysiologic model of the cardiac action potential, represented by a set of ordinary differential equations, has been integrated. The short-term ANS regulation of heart rate, cardiac contractility and peripheral vasoconstriction is represented by means of continuous transfer functions. These models, represented in different continuous formalisms, are coupled by using a multi-formalism simulation library. Results are presented for two different autonomic tests, namely the Tilt Test and the Valsalva Manoeuvre, by comparing real and simulated signals. (shrink)

This paper introduces a refined approach to conceptualising the commons in order to shed new light on cooperative practices. Specifically, it proposes the novel concept of Common-Property Assets. CPAs are exclusively human-made resources owned under common-property ownership regimes. Our CPA model combines quantity and quality. While these two dimensions are largely pre-existing in the conventional case of natural common-pool resources, they directly depend on members’ collective action in CPAs. We apply this theoretical framework to farm machinery sharing agreements—a widespread grassroots (...) cooperative phenomenon in agriculture—using a systematic literature review to generalise the findings from a sample of 54 studies published from 1950 to 2018. Our findings show that in successful CPAs, members endorse and do not deviate from a quantity-quality equilibrium that is collectively agreed upon. Despite the existence of thresholds for both quantity and quality due to membership heterogeneity, qualitative changes in respect of the common good are possible in CPAs that promote democratic practices. This book critically investigates the notion of democracy without demos by unravelling the link that modern history has established between the concepts of democracy and the sovereignty of the people. This task is imposed on us by globalization. The individualization of the subject of rights is the result of the destruction of regimes of special rights of ancient societies by the centralizing action of a territorial power. This individualization, because it implies equality, has created a new form of political subjectivity (...) that has been the driving force of the democratization of democracies during the 19th and 20th centuries. Democracy and subjective rights discusses how asserting itself as the only guarantor of rights, the modern state has also nationalized citizenship. However, the author argues, the legal and judicial monopoly of the nation-state is weakened today by the multiplication and heterogeneity of the powers on which the rights of individuals depend. This situation forces us to denationalize citizenship without sacrificing, however, the specific form of political subjectivity that the individualization of rights has made possible. (shrink)
